In Radical Decision, Supreme Court Rules Age Verification Constitutional

“This shocking decision goes far beyond adult content or adult websites,” says Alison Boden, Executive Director of Free Speech Coalition. “The Court has ignored the traditional protections of the First Amendment online and given states free reign to censor controversial content and ideas, so long as the goal is to protect children.” Read more on our blog... FSC Celebrates Jeffrey Douglas

On June 27, FSC hosted a special gala in Hollywood to honor board chair Jeffrey Douglas for his 30 years of service to the adult industry. As the community continues to face mounting legal challenges, the evening was a powerful reminder of the strength, resilience, and legacy of our movement. Gathering together to recognize those who’ve spent decades defending our rights helps ground us in what we’re fighting for. Jeffrey’s unwavering commitment to free speech and due process has shaped our legal defense for over three decades. View photos from the night here… ( [link removed] )

Legal Update

Age-Verification Laws Go Into Effect In South Dakota, Georgia, Wyoming on July 1st

The Georgia law ( [link removed] ) creates a private right of action for lawsuits against websites with 33 ⅓ percent material “harmful to minors,” similar to the laws in many other states.

The Wyoming law ( [link removed] ) creates a private right of action for lawsuits against websites. However, the law appears to *apply only to “obscene” content* or CSAM, meaning content that is already illegal to distribute. However, the potential for lawsuits may still exist.

The South Dakota law ( [link removed] ) , enforced by the South Dakota Attorney General, allows for civil lawsuits against any website containing *any* amount of material “harmful to minors,” abandoning the 33 ⅓ percent standard used in other states.

For detailed information on these and other age-verification laws, refer to FSC’s Frequently Asked Questions About Age Verification ( [link removed] ). Read more on our blog... ( [link removed] )

Elena Kagan Torches Supreme Court's Terrible Logic In Porn Ruling

“In a scathing dissent ( [link removed] ) joined by Justices Sonia Sotomayor and Kentanji Brown Jackson, Kagan accused the majority decision in Free Speech Coalition v. Paxton of diluting First Amendment protections for sexually explicit speech.” Read more on New Republic. ( [link removed] )

The Supreme Court Just Upended Internet Law, And I Have Questions

“The question ‘What is porn?’ is going to have a tremendous impact on the internet — not just because of what courts believe is obscene for minors, but because of what website operators believe the courts believe is obscene. This is a subtle distinction, but an important one.” Read more on The Verge. ( [link removed] )

Bluesky Is Rolling Out Age Verification In The UK

Starting July 25, Bluesky will require UK users to verify their age to comply with the country’s Online Safety Act. Users can verify by scanning their face, uploading an ID, or using a credit card. Those who don’t verify—or are under 18—will still be able to use the platform, but with key features like direct messaging and access to adult content restricted. The Online Safety Act, passed in 2023, requires platforms to implement “highly effective age assurance” or face steep fines. Read more on The Verge. ( [link removed] )

Age Verification Is Coming To Search Engines In Australia

New regulations set to take effect by the end of 2025 will require Australians to verify their age when using search engines like Google and Bing. The rules mandate platforms implement “appropriate age assurance measures” and default to strict Safe Search settings for users identified as children. The move mirrors similar restrictions seen in the UK and marks a growing trend of governments pushing age verification far beyond adult sites. Read more on Mashable. ( [link removed] )

China Detains Female Erotica Writers In Pornography Crackdown

Dozens of women in China have been detained for writing gay erotica—known as “boys’ love”—in a nationwide anti-pornography campaign. The crackdown has sparked outcry over censorship, sexism, and harsh punishments, with many of the writers earning only modest royalties through niche, paywalled platforms. Advocates argue the move targets low-income women and LGBTQ+ content while ignoring more mainstream harmful material. Some writers now face lengthy prison terms under obscenity laws, as online debate grows over the government’s double standards and suppression of free expression. Read more on Reuters.
