The Tobacco Manufacturers’ Association is running an advertising campaign targeting holidaymakers considering reselling cheap tobacco bought overseas. The campaign points out that such tobacco has not had UK taxes paid, and its resale carries with it risk of prosecution and a criminal record.

No limits are currently imposed when returning from another EU country, but anyone bringing excessive quantities of tobacco in their baggage might need to prove to law enforcement authorities that it is for their personal use. For those holidaying outside the EU, the allowance is 200 cigarettes or 250g of rolling tobacco, duty free.

The campaign, which runs until the end of September, targets tourist hubs that include Manchester, East Midlands, Glasgow Prestwick, Glasgow International and London Luton airports, the port of Dover and central city locations in London and Edinburgh.

The respective owners of three unconnected shops in Ipswich have been prosecuted as part of an illicit tobacco sting operation. Prosecuting on behalf of Suffolk Trading Standards, Richard Power said the charges came from an operation carried out on April 25 last year after officers received intelligence illicit tobacco products were being sold from the shops.

Undercover officers, acting as customers, managed to buy illicit cigarettes from all three of the stores. Search warrants were executed a few months later, discovering more illegal tobacco products at all three shops. In mitigation, all three men said they were not hands on at their businesses day to day and that they did not know illicit tobacco had been sold through their premises.

Presiding magistrate Paul Thacker handed the three men each an eight week prison sentence, suspended for one year. mHe also ordered two of the men to pay fines each of over £2,000. Additionally, all three shop owners were made to pay a £122 victim surcharge.
