This week, the Wisconsin Supreme Court reshaped the balance of power in Wisconsin, stripping the State Legislature of its long-held ability to block administrative rules.
In a 4-3 decision, the court ruled that statutes granting the Joint Committee for Review of Administrative Rules (JCRAR) such authority violate the Wisconsin Constitution.
This landmark ruling stems from challenges brought by Governor Tony Evers, specifically targeting JCRAR's actions to block commercial building codes and suspend a rule that banned conversion therapy. For decades, lawmakers have used this power to at least temporarily halt agency regulations, but no more.
WILL has been a leading advocate for the separation of powers, and opposes multiple SCOWIS rulings and actions by Governor Evers that have wrongfully cemented power within the Executive Branch, and denied the duly elected legislature their rightful oversight.
