 What healthcare facilities and e-cigarette retailers need to know about Michigan's new hazardous waste regulations
On April 29, 2025, amendments to the administrative rules promulgated under Part 111, Hazardous Waste Management, of Michigan’s Natural Resources and Environmental Protection Act, 1994 PA 451, as amended (Part 111), were filed with the Michigan Department of State, Office of the Great Seal. The amended rules became effective on May 5, 2025. They are found in Part 111, Rules 824 through 833, and in the corresponding federal regulations published in the Federal Register on February 22, 2019.
The new rules are specific to:
- Healthcare facilities generating hazardous waste pharmaceuticals (HWP).
- Electronic nicotine delivery systems (ENDs) retailers generating unwanted ENDS.
Existing facilities subject to the new rules are required to notify the Michigan Department of Energy, Great Lakes, and Energy (EGLE) of the facility's regulatory status by July 4, 2025, using the EQP 5150 Form. EGLE will accept all notifications provided by affected facilities.

As of the May 5, 2025, effective date of the amended rules, pharmaceuticals can no longer be managed as a universal waste in Michigan. The universal waste designation was rescinded as required to meet the federal rulemaking. Join us for this webinar to learn:
