Categorical Exclusion Determination, Town of Moorcroft, WY, Lead Service Line Identification and Replacement Project
The Wyoming Department of Environmental Quality/Water Quality Division (DEQ) has conducted a review of the proposed Town of Moorcroft Lead Service Line Identification and Replacement Project in accordance with EPA and State of Wyoming procedures for implementing the State Environmental Review Process. DEQ has determined that this project is eligible for a categorical exclusion. Accordingly, DEQ is exempting the project from further substantive environmental review requirements under the State Environmental Review Process. Neither an Environmental Assessment/Finding of No Significant Impact nor an Environmental Impact Statement/Record of Decision will be required for the proposed action. The following is a brief description of the situation and the proposed action and a brief statement of how the action meets the criteria for a categorical exclusion.
The Town of Moorcroft is undertaking a Lead Service Line Identification and Replacement Project to comply with the Environmental Protection Agency’s Lead and Copper Rule Improvements (LCRI). This project will include a town-wide inventory to identify lead or galvanized service lines requiring replacement. Where such materials are found, the Town will remove and replace the existing service lines from the municipal water main to the interior meter of each connected structure. All work will occur within existing municipal rights-of-way and disturbed areas.
The estimated total project cost is $733,730.45 for the Town of Moorcroft Lead Service Line Identification and Replacement Project as identified on the 2026 Wyoming Drinking Water State Revolving Fund (DWSRF) Intended Use Plan under the Bipartisan Infrastructure Law (BIL) Lead Service Line Replacement category.
The Town of Moorcroft is aware of and accepts the fact that it will be responsible for any required mitigative actions associated with and including storm water runoff, erosion control, archeological/historic artifacts, and air quality concerns. These responsibilities will be included in the standard State Revolving Funds Program contract conditions.
Based on environmental agency coordination and internal review, no significant impacts are anticipated. However, the following standard environmental protections will apply:
DEQ, Air Quality Guidance: Dust control measures will be implemented during excavation in accordance with WAQSR Chapter 3, Section 2(f). Open burning of construction waste is prohibited, and proper handling procedures must be followed if any suspect asbestos-containing materials are encountered.
State Historic Preservation Office Guidance: Concurrence was received stating no historic properties are likely to be affected. In the event of unanticipated discoveries, work will cease in the area and appropriate coordination will be initiated per the Secretary of the Interior’s Standards.
U.S. Fish and Wildlife Service Guidance: If native birds are observed nesting or roosting on structures, avoid disturbing adults, nests, eggs, or chicks to prevent potential violations of the Migratory Bird Treaty Act. If active nests or regular bird use is present, coordinate with the USFWS Field Office and consult the Migratory Bird Program guidance. Comply with the National Bald Eagle Management Guidelines. If a bald eagle nest is discovered within 660 feet of any construction activity, stop work immediately and coordinate with both USFWS and Wyoming Game and Fish Department (WGFD) for further direction. All work must remain within the designated project footprint. Any changes to the footprint may require additional environmental consultation and review.
Wyoming State Engineer’s Office, River Basin Coordinator Guidance: If at any point the project contemplates additional non-municipal water supply, a new assessment would be warranted. If additional water is necessary for construction purposes, please file the proper applications with the State Engineer’s Office.
DEQ is granting an exclusion because the project involves the replacement of existing infrastructure, specifically the identification and removal of lead and galvanized service lines and the installation of new lead-free service lines. All work will occur within established municipal rights-of-way and utility corridors and does not involve the expansion of system capacity or development of new facilities. This project will be completely constructed in previously disturbed ground, specifically ground previously disturbed by existing water mains, residential service connections, and roadway corridors. Excavation will be limited to narrow trenches and small-scale potholes adjacent to roadways and sidewalks. DEQ has determined that exempting the proposed project from further review under the State Environmental Review Process will not result in adverse impacts to the population or the area of Moorcroft, Crook County, Wyoming.
