Team — On Friday, the Supreme Court handed down its decision in the birthright citizenship case. We want to make this clear: Birthright citizenship remains intact and continues to be a right enshrined under the U.S. Constitution.
The case stems from an executive order signed by Donald Trump on his first day in office, attempting to ban birthright citizenship — a right enshrined in the 14th Amendment of our Constitution. The executive order was immediately blocked in two different federal courts. When the lower courts refused to buckle to the administration's agenda to dismantle the 14th Amendment, they rushed the case to the Supreme Court.
By not recognizing the clear unconstitutionality of the executive order, the Supreme Court has abandoned its duty to the American people and leaves not only immigrant communities, but all Americans’ constitutional rights up for grabs.
Friday's ruling was not on whether birthright citizenship could be dismantled, but rather, whether the lower courts could restrain the administration’s executive order from taking effect nationally. A much longer fight is ahead if the administration continues its efforts to dismantle the 14th Amendment.
At the heart of this battle is a debate over who gets to be considered American.

The attacks to dismantle the 14th Amendment are about exclusion and division: about saying that if you look a certain way — if you’re Black or brown, if you speak a different language, have an accent, or were born in a different country — you shouldn't be afforded your rights.
