Today marks the 12-year anniversary of the Supreme Court’s disastrous Shelby County decision.

The details: The decision nullified Section 5 of the Voting Rights Act, effectively gutting preclearance — a safeguard that had been in place since 1965 to prevent states from implementing discriminatory barriers. States saw this move as an open invitation for states to make voting hard for people of color, and for extremists to manipulate maps. The VRA’s preclearance provision mandated that jurisdictions with a record of voter discrimination were obligated to get federal approval before making any changes to their election law, including redistricting plans.

The aftermath: States immediately began to engage in efforts to restrict access to the ballot. On the very day of this decision, Greg Abbott, the Texas Attorney General at the time, announced that Texas would put “the most restrictive voter ID law in the nation” into place. Texas wasn’t the only state to react accordingly to this decision. To top it off, the maps that were drawn in the redistricting cycle immediately after the Shelby County decision were deliberately manipulated to dilute Black voting power as the far right attempted to consolidate their power unfairly.

Now: Anti-democracy forces are still engaging in predatory tactics aimed at suppressing the power of voters, from laws that unjustly restrict access to the ballot box to maps that keep communities of color from being able to elect the candidates of their choice.

Our affiliate, the National Redistricting Foundation, has supported voters in bringing court cases currently active in five states — Alabama, Florida, Georgia, Louisiana, and Texas — that could decide the makeup of up to seven state legislative districts and six congressional districts where we must ensure fair representation.

As we reflect on the long-lasting impacts of Shelby County, we also take the moment as an opportunity to ground ourselves in why we’re leading the fight for fair maps.

We cannot afford to stand idly by as a guiding principle of American government is dismantled. Our democracy is fragile, and we each need to do our part to strengthen it.
