I may not be an expert on the use of presidential power to conduct military operations, however, I know this: the Constitution grants Congress the power to “provide for the common defense” and to “declare War.”
Presidents and Congress have often tussled over the use of military force without a formal declaration of war. However, presidents have typically found ways to at least acknowledge and offer some respect to Congress’s role under the Constitution.
Trump does not respect the Constitution — full stop — and it has been a hallmark of his administration to intentionally ignore Congress’s constitutional authority. Trump has eliminated departments and agencies created by Congress. He has refused to spend money they have appropriated. He has issued executive orders claiming powers over elections that belong only to the states and Congress. Most recently, he has limited the ability of members of Congress to visit ICE detention facilities in direct contravention of federal law.
At first glance, his disregard for Congress may seem odd. After all, Republicans control Congress and would surely fall in line to give Trump whatever power and authority he requests. But this misses the point...
