Pennsylvania is one of only 8 states in the country where Supreme Court justices are initially elected through partisan elections. At the end of their 10 year terms, voters decide on whether to retain them in non-partisan retention elections. In November, Pennsylvania voters will vote “yes” or “no” to retain three Pennsylvania Supreme Court Justices on the ballot. Which means PA is once again a key battleground state this year.
Here is how it will work:
As reported by WHYY News, Democrats currently hold a 5-2 majority on the state's highest court, but three justices elected as Democrats are nearing the end of their terms. This November, voters will get to vote either “yes” or “no” on whether they should serve another term, and MAGA Republicans are eyeing these races as their chance to flip the balance of the courts.
If Republicans are successful in their anti-retention campaign, the PA Supreme Court could have three vacancies until the Governor is able to appoint and confirm their replacements (which is unlikely as this would require support from Republicans in the PA Senate) or until the next judicial election in 2027.
With the Trump regime getting more and more aggressive in its attempts to strip away our freedoms and undermine our nation’s constitution, it’s more critical than ever that we ensure our courts are fair and independent. Republicans aren’t sneaky with their plan – they want a Republican majority on the PA Supreme Court before the next presidential election in 2028. That is why they are trying to rally their base by regurgitating Trump’s baseless Big Lie to say the 2020 election was stolen.
