Take two minutes to contact your senators and urge them to pass legislation that provides crucial COVID-19 relief for EVERYONE. >>> That’s why it was so appalling to see Secretary Betsy DeVos and the U.S. Department of Education create new eligibility restrictions based on immigration status, in an attempt to prevent colleges and universities from helping all their students survive this crisis. When Congress passed the CARES Act, it didn’t place any restrictions on which students could receive emergency education funds. The COVID-19 pandemic is an unprecedented global crisis. In this time of emergency, Congress crafted a flexible legislative response to meet the needs of the educational community and all students experiencing the pandemic’s disruptions. When Betsy DeVos unilaterally chose to exclude immigrants, including DACA recipients, from receiving emergency education funds, the California attorney general sued her in federal district court. We filed an amicus brief in support of the attorney general’s case, which lawyers arguing the case cited in court last week. This week the court decided in immigrant students’ favor. As a result, California community colleges can provide crucial aid to students, regardless of immigration status, to help them survive through this crisis. While this is a victory, Congress must do more to provide economic relief for everyone. We can no longer afford to wait — we must keep fighting this pandemic with policies that are inclusive of everyone, including immigrants. All emergency relief efforts must be available to all, regardless of immigration status. The health of our communities depends on it.
