Dear John,

Yesterday, the U.S. Supreme Court dealt a disappointing blow to the rule of law.

In America, Congress makes the law. It says so in our Constitution. That power does not belong to unelected bureaucrats, government agencies, or the courts.

That’s why Tom Rost had asked the high court to hear his case.

Tom owns R.G. & G.R. Harris Funeral Homes, a fifth-generation family business that is known for excellence.

A large part of his family’s legacy is the high level of professionalism and service the team provides to the families and friends of the deceased—it’s what sets Harris Funeral Homes apart. That’s why the organization has always maintained professional codes of dress and conduct.

And Title VII allows businesses like Harris Funeral Homes to maintain a sex-specific dress code. Or at least it did—until now.

The U.S. Supreme Court has redefined “sex” to include “gender identity”

When an employee at Harris Funeral Homes expressed an intent to begin violating the dress code while working with grieving families, Tom had a decision to make. He prayerfully considered the needs of this employee, other employees, and his clients. Ultimately, he concluded that he could not agree with the employee’s plan.

Now 7 years later, the U.S. Supreme Court has ruled against Tom simply for relying on what the law said.

In the majority opinion, the high court redefined “sex” in Title VII to include “gender identity.” As you can probably guess, this decision will have significant consequences for businesses, including calling into question their ability to enforce sex-specific dress codes on the basis of biological sex.

But the dress code is only a small part of the story, John.

Redefining “sex” to include “gender identity” could create chaos and enormous unfairness for women and girls.

Not only that, but this decision could encourage unelected officials and courts to rewrite other statutes—forcing Americans like you to have to guess what a law means.

After all “sex” and “gender identity” are fundamentally different things.

“Sex” defines whether someone is male or female as an objective fact based on biology. But “gender identity” is a fluid, difficult-to-define concept based on subjective perceptions.

The Supreme Court’s decision is a drastic change with widespread consequences for everyone—including you and your family.

How activists could use this decision to advance their political goals

Activists have tried dozens of times to amend Title VII to add first “sexual orientation” and then “gender identity.” Yet they have failed to convince Congress to change the law because of the potential harms to women and girls, freedom of speech, and religious liberty.

So activists turned to the courts to advance their policy preferences. And sadly, the Supreme Court’s decision encourages that type of behavior.

But that’s not how democracy is supposed to work, John.

What federal employment law protects is the type of issue that elected officials have the right to decide subject to your vote. Unelected officials—whether bureaucrats or judges—should not have the power to make these choices for you.

That’s why the U.S. Supreme Court’s decision is so troubling—for Tom and for us all. People should have the right to rely on what the law says—not what government agencies or activists want it to be.
