Last night, the U.S. Court of International Trade unanimously invalidated most of President Trump’s sweeping tariff tax scheme. The Court ruled that the statute which Trump invoked to roll out his broad, indiscriminate tariff policies does not grant him the ability to apply unbounded tariffs as he pleases. This case is proof of what Advancing American Freedom has been saying all along: tariffs are taxes, and the power of taxation belong to Congress alone. Get a full summary of the case HERE AAF Has Been Leading The Charge Raising Concerns About Tariffs While some have been oscillating back and forth on this administration’s unpredictable tariff policies, AAF has remained consistent in upholding the traditional conservative principle of free trade with free nations. We have a long-established history of being the leader in this space. Media Leadership – In January, AAF released a comprehensive guide to effective tariff policy. As evidenced by the Trump-Pence administration, tariffs are powerful and effective tools when leveraged against our enemies. However, broad and indiscriminate tariffs are taxes on the American people, plain and simple. We outlined how Trump’s broad tariffs would cost American families $3,500 a year, ending America’s “Golden Age” before it has the chance to start. We also explained how Trump’s steep tariffs on in sectors like auto manufacturing could damage the economies of entire cities. Working With Lawmakers – AAF has become an indispensable resource for our nation’s legislators on tariff policy. This upcoming Monday, our Chairman, Marc Short, will be leading an event on Capitol Hill in Washington titled “The Use and Abuse of Tariffs”, where over 100 congressional staffers will be in attendance. This is the first in a series of Capitol Hill events AAF plans to roll out this summer to continue working with Congress to ensure a sound and effective tariff policy is reached. Courtroom Presence – The AAF legal team continues to be the premier source of constitutional thought when it comes to tariffs. As our General Counsel Marc Wheat pointed out last month, Trump's tariffs are taxation without representation. If and when this ruling is appealed, our legal team stands prepared to file amicus briefs at the Court of Appeals for the Federal Circuit and, if needed, the Supreme Court, to uphold the Constitution and the freedoms it exists to protect. On The Road – AAF’s outreach transcends the confines of the DC swamp. As we shared last week, we partnered with the John Locke Foundation to host a business roundtable in Raleigh, NC, to discuss the negative impact of tariffs on prices, manufacturing, small businesses, and more. We are excited to host more of these events across the country as the year goes on. Vice President Pence also brought the same message to Grove City College back in April, making sure that the next generation of leaders is involved in the conservative fight for constitutional order.
