In 2022, Paxton filed a lawsuit against the ATF, challenging federal regulations that prohibit firearm suppressors made and used exclusively within Texas. He argued that these regulations violated the Second Amendment by imposing federal oversight on intrastate firearm components.
In 2024, Paxton, along with other Republican state Attorneys General, filed lawsuits against the Biden administration’s expanded background check requirements for firearm sales at gun shows and online. They argued that the ATF exceeded its authority and that the new rule infringed upon Second Amendment protections.
