The Trump administration is once again testing the limits of executive
power. Stephen Miller, Trump’s top policy adviser, says they are “actively
looking” at suspending habeas corpus for migrants – the constitutional
right to challenge detention before a judge.
And in a startling admission, Miller said their decision may hinge on

That’s not policymaking. It’s a direct threat to judicial independence and
the rule of law.

This isn’t just extreme. It fits into a growing pattern of contempt for
constitutional checks and balances.
Time and again, Trump and his cronies have pushed beyond legal boundaries.
When courts issue rulings they don’t like, they ignore them. When
fundamental rights stand in their way, they look for ways to bypass them.
The idea of suspending habeas corpus would take this even further.

Legal experts across the political spectrum are warning how extreme and
dangerous this would be. No modern president has formally suspended habeas
corpus or claimed the authority to do so outright. This Constitutional
right is a cornerstone of our legal system. It cannot be tossed aside
because it’s politically inconvenient.
They may start with migrants, but history shows that once a government
claims the power to imprison people without oversight, that power often
does not stay confined to one group.
If we stay silent, this kind of abuse could become the new norm. We cannot
allow the government to decide who deserves legal protections based on
politics or convenience.
This is the moment for lawmakers to draw a clear line. Suspending habeas
corpus is unacceptable. It must be rejected completely.
