Update on Election Issues

1.  April 12, 2025: The Board of Supervisors sent Recorder Justin Heap a proposed shared service agreement based on Recorder Heap’s own proposal to the Board along with adjustments agreed to in an April 11th meeting. The Board of Supervisors is waiting on Mr. Heap’s response.

Note: A Shared Service Agreement (SSA) is used to spell out the divided election duties between the Elections Department and the Recorder, especially where state law is unclear.  In broad terms, the Recorder is in charge of voter registration, updating the voter rolls, mailing out early ballots and verifying signatures on the early ballot envelopes.  The Elections Dept. is in charge of tabulation of ballots and in-person voting.

2.  May 5, 2025: The Board of Supervisors voted to block Recorder Heap’s plan to mail out ballots to voters even if they didn’t request one.

Why? Because it’s illegal and it sets a bad precedent.

I want to thank County Attorney Rachel Mitchell for her unwavering commitment to election integrity and for setting the record straight on this bad precedent. She said that the Recorder cannot lawfully mail ballots to voters that didn't request them. Democrat Adrian Fontes tried to do this and was blocked in court.
