Division: Field Services and Public Safety (Boiler Program)

Topic: Adoption (CR-103) – Boiler Rule: Pool Heater Definition & Fee Increases (FY26)

Brief Description: The purpose of this rulemaking is to adopt amendments to the boiler rules under chapter 296-104 WAC, Board of Boiler Rules – Substantive. The amendments affect the definitions and fees for boilers and pressure vessels. The adopted amendments are needed to clarify inspection requirements for pool heaters and increase fees to support the operating expenses of the Boiler Program.

Division: Field Services and Public Safety (Contractor Registration Program)

Topic: Adoption (CR-103) – Contractor Registration Fees Increase (FY26)

Brief Description: The purpose of this rulemaking is to adopt amendments to the Contractor Registration fees under WAC 296-200A-900. The adopted amendments will increase fees by the fiscal growth factor of 6.41% to cover operating expenses for L&I’s Contractor Registration Program. This is the Office of Financial Management’s maximum allowable fiscal growth factor rate for fiscal year 2026. The current fee levels are insufficient to cover current Program expenses. The fee increase is necessary to ensure that revenues match expenditures.

Division: Field Services and Public Safety (Contractor Registration Program)

Topic: Preproposal (CR-101) – Online Insurance Submittal for Registered Contractors and Licensed Plumbing Contractors

Brief Description: The purpose of this rulemaking is to consider amending the contractor registration and plumbing contractor licensing rules under Chapters 296-200A and 296-400A WAC to fully transition to an online insurance system. Currently, L&I accepts paper copies of general liability insurance certificates, reinstatements, and cancellations for contractors by mail and in-person. This process is timely, costly and inefficient for both the agency and customers. The amendments under consideration would require insurance companies to submit insurance documents and information electronically through the Electronic Bond and Insurance Policy System (EBIPS). L&I would no longer accept paper copies by mail, in-person, or through any other electronic method for contractor registration or plumbing contractor licensing. The only exception would be for first-time applicants for contractor registration or plumbing contractor licensing; these first-time applicants could submit insurance documents and information by mail or in-person. In addition, L&I currently requires that the agency be listed as the certificate holder on the certificate of insurance and is considering adding this requirement to the rule to ensure clarity.

Division: Fraud Prevention and Labor Standards (Prevailing Wage Program)

Topic: Adoption (CR-103) – Prevailing Wage (SHB 2136 Implementation)

Brief Description: The purpose of this rulemaking is to amend four sections in rule to implement Substitute House Bill 2136 [ [link removed] ] (SHB 2136), Chapter 7, Laws of 2024. The Attorney General’s Office proposed this bill to close a loophole within Prevailing Wage law, expand the definition of contractor to include substantially identical entities to debarred and sanctioned contractors, and extend sanctions and penalties to those substantially identical entities.

*Effective date: January 1, 2026*
