The battle over gender ideology is reaching a critical point.
While many states have taken decisive action to protect minors from harmful and irreversible "gender transition" procedures, others are moving in the opposite direction, forcing counselors into a corner where they can only affirm a child's gender confusion instead of providing true help and healing.
As you and I wait for the critical U.S. v. Skrmetti decision, which will decide whether states can prohibit gender transition procedures on minors, another critical case has emerged -- this time in Colorado.
Licensed counselor Kaley Chiles is challenging legislation recently passed in Colorado that requires counselors to affirm their client's gender identity. In other words, Kaley is free to encourage a child to pursue pharmaceutical and invasive medical interventions such as puberty blockers, hormones, and surgeries that remove healthy organs and tissue, but she is prohibited from helping them address the underlying causes of their distress and embrace their God-given identity.
Not only is this legislation a gross violation of Kaley and other counselors' First Amendment rights, it jeopardizes responsible care for patients in the state of Colorado.
The division across various states is stark. More than half are trying to protect children from irreversible harm, while the other half, like Colorado, mistakenly believe they are helping young people by allowing, encouraging, and in some instances, forcing this radical ideology onto them. That's why FRC is advocating for federal legislation that would protect children from the harms of gender transition procedures.
Our model SAFE (Save Adolescence From Experimentation) Act, which we began developing back in 2017 alongside like-minded organizations, laid the groundwork for multiple states to pass legislation protecting vulnerable children from harmful physiological interventions. Since the first SAFE Act was passed in Arkansas in 2021, 27 states have now passed similar laws protecting minors.
Although we've seen good progress at the state level, you and I cannot stop there. We must work together to advance federal legislation that will ensure minors are shielded from these life-altering and destructive interventions.
