The Department of Social and Health Services Aging and Long-Term Support Administration Home and Community Services division filed rules with Washington State Code Reviser's Office during February 20, 2025-March 15, 2025. CR-101 Preproposal Statement of Inquiry
WAC 388-106-0015 What long-term care services does the department provide? WAC 388-106-0336? What services may I receive under the residential support
waiver?, and WAC 388-106-0338 Am I eligible for services funded by the residential support waiver?. The Department of Social and Health Services is considering amending the above rules relating to the residential support waiver and considering amending other related rules as necessary. Filed as WSR 25-07-002 [ [link removed] ] on March 5, 2025.
CR-103P Rulemaking Order (Adopted Rules)
The department adopted rules that are in compliance with Senate Bill 5811 passed during the 2024 legislative session. These rules clarification of continuing education requirements related to the date of hire, acknowledgement of the Interstate Nurse Licensure Compact related to training requirements; and combining WAC 388-71-0990 and WAC 388-71-0991 into a single section. The Department of Social and Health Services (department) is adopting amendments to the following WAC 388-71-0503-What definitions apply to WAC 388-71-0500 through WAC 388-71-05640, WAC 388-106-0010-What definitions apply to this chapter?, WAC 388-106-0060-Who must perform the assessment?, and WAC 388-115-0516-What are the responsibilities of the consumer directed employer when providing care to a client?. The department is allowed to contract with a federally recognized Indian tribes to determine eligibility including assessments and reassessments, authorize and reauthorize services, and perform case management functions for Medicaid-long term services and supports for clients within the tribe’s authority. CR-103E Emergency Rules
The Department of Social and Health Services (department) is amending WAC sections 388-71-0523, 388-71-0880, 388-71-0888, 388-71-0890, 388-71-0977, and 388-115-0523. The purpose of these changes is to bring rules into compliance with Senate Bill 5811 (chapter 322, Laws of 2024). This rulemaking expands the definition of individual provider, and permanent rules will replace the emergency rule. Filed as WSR 25-06-016 [ [link removed] ]on February 20, 2025.
