Women held 55% of the jobs lost in the wake of the COVID-19 pandemic. Female-dominated service sectors--such as food service, hospitality, and child care--were among the hardest hit. This drove women’s unemployment up to 15.5%, a historic high, in April. As with many things, the pandemic will reveal many things about the American economy and shape its future. Over the past century, policymakers have stretched our Constitution’s separation of powers to the breaking point. Today, Congress routinely, and often unconstitutionally, delegates legislative power to administrative agencies in the executive branch. But can the executive branch create an administrative agency out of thin air? In Oracle America, Inc. v. Department of Labor, plaintiffs are asking a federal district court to declare the Office of Federal Contract Compliance Programs (OFCCP) unconstitutional. Oracle is not just another technical administrative law case. Nor is it a case about the government’s power to fight discrimination. Oracle touches the very heart of our system of representative government, and it will have important implications for the limits of government power.

Rioters vandalized the Lincoln Memorial. The riots sparked from protests over the horrific death of George Floyd in police custody. We were outraged when we saw a video of an officer kneeling on Floyd’s neck, and we all want justice for George Floyd. No one would agree with this as strongly as Abraham Lincoln. President Lincoln believed in freedom and the dignity of all people. The rioters chose the wrong (not like there is a right) place to deface: the Lincoln Memorial.

Before it was hijacked by the far-left, the feminist movement was about equipping and empowering women to pursue both a family and a career. It’s long past time we return to that and make permanent work-from-home options the new feminist frontier. Not all work can be performed remotely, and women will still face many challenges in trying to balance competing goals, including work and family life. But the prospect of greater workplace flexibility is a silver lining to come from the COVID-19 crisis--and one that could unite feminists from all sides.

Democratic countries have a history of tisk-tisking communist China’s horrendous behavior, and then doing nothing much about it. Finding ways to punish China for the harm of the coronavirus pandemic is not just a matter of pursuing justice, gratifying though that would be. It is also vital to deterrence, to driving home to President Xi Jinping, and his communist cadres, that inflicting damage on America, and on our friends and allies, will entail a price that China’s ruling Communist Party cannot afford.
