Executive Branch Updates:

Recent executive actions targeting immigrants include efforts to strip DACA recipients of ACA access and claim to impact eligibility for federal programs. 

 

Proposed rule to strip DACA recipients of ACA marketplace access

  • The Centers for Medicare & Medicaid services issued a proposed rule stripping people with DACA’s access to the ACA marketplaces and basic health plans (only available in New York and Minnesota).  It would keep the clarifying changes that provided eligibility for certain other immigrants, including people granted Special Immigrant Juvenile Status, children seeking asylum or other humanitarian relief and applicants for adjustment to lawful permanent resident status.
  • Comments are due on Friday, April 11.

 

Immigrant Benefits Executive Order (EO) Round Up

  • Trump’s EO 14218, issued on February 19, is an effort to identify and stop the federal funding of programs for people who are undocumented, but it does not change eligibility policy for federal programs. Instead, it asks all federal agencies to ensure the programs that they fund do not provide federal funding for benefits for people who are undocumented or otherwise ineligible based on their immigration status. 
  • The Food and Nutrition Service (FNS) issued a letter to states on March 18 that does not change eligibility for SNAP. The letter says that FNS will provide further guidance that will push states to fully implement reimbursement for the cost of SNAP, and deem the income of sponsors to applicants for SNAP.  Keep in mind that there are exemptions to sponsor deeming and liability under federal law and enforcement of sponsor liability is not required under current policy. 
  • The U.S. Department of Agriculture and the U.S. Department of Health and Human Services, Administration for Children and Families have issued letters in response to the EO.  However, these letters also do not change eligibility for any programs.
  • The U.S. Small Business Administration (SBA) letter suggests that it will be issuing a new policy requiring U.S. citizenship and immigration verification for loan applications so that people who are undocumented do not benefit from loans and that they will relocate regional offices in cities that allegedly do not comply with U.S. Immigration and Customs Enforcement.

Next Friday, March 28, at 1:00pm EST is our next session of “Moving Stillness: Grounding in Times of Chaos,” a free bi-weekly virtual space to recharge your batteries, find healing in community, and build balance in turbulent times. Chalene Jones (Taijiwithchalene.com) will facilitate Taiji and Qi Gong practices, as well as reflective space to help advocates feel restored and revitalized for the work ahead. To help prepare you, Chalene has shared two videos demonstrating the kinds of movements we’ll engage in in each session. Sessions will be held every other week through June. All levels and abilities are welcome! No equipment or experience necessary. Check out the videos below to learn more and practice on your own, and register for upcoming sessions.
