Governor Asa Hutchinson Announces Intent to Grant Executive Clemency
LITTLE ROCK – Governor Asa Hutchinson today announced his intent to grant five pardons, and three commutations. An additional 46 clemency requests were denied and one had no action taken upon them. These include requests from both inmates and non-inmates.
The applicants intended for pardons have completed all jail time, fulfilled all parole and probationary requirements and paid all fines related to their sentences. There is a 30-day waiting period to receive public feedback on the notices before final action is taken.
Governor Hutchinson intends to grant pardons to the following people:
Tracy Drane (Lincoln): Arkansas Hot Check Law (C Felony)(CR 2001-845-2).
This notice is issued based on the dates of conviction (2004 – Benton County), the fact that all terms of the applicant’s sentence have been completed and there have been no further criminal-law violations. There are no law enforcement objections to the application.
Jesse Flack (Conway): Violation of Arkansas Hot Check Law (A Misdemeanor)(CR 99-248), Forgery II 5 counts (C Felony)(CR 2001-0682), Fraudulent Use of a Credit Card (C Felony)(CR 2001-0682), and Hot Check Violation >$200 but < $2,500 (C Felony)(CR 2001-0879).
This notice is issued based on the date of conviction (1999 and 2001 - Craighead), the fact that all terms of the applicant’s sentence have been completed and there have been no further criminal-law violations. There are no law enforcement objections to the application.
Tabitha Fondren (Fort Smith): Breaking or Entering (Reduced) (D Felony), Theft of Property (C Felony) (CR-2000-561), Forgery in the Second Degree (C Felony) (CR-2000-924), Possession of Methamphetamine (C Felony), Possession of Drug Paraphernalia (C Felony), Possession of Ephedrine (D Felony) (CR-2001-261), Possession of Drug Paraphernalia (C Felony), Possession of Methamphetamine (C Felony) (CR-2001-284), Breaking or Entering (D Felony), and Criminal Mischief in the Second Degree (B Misdemeanor) (CR-2001-468).
This notice is issued based on the date of conviction (2001 - Sebastian County), the fact that all terms of the applicant’s sentence have been completed and there have been no further criminal-law violations. There are no law enforcement objections to the application.
Craig Smith (Mabelvale): Manufacture of a Controlled Substance- Marijuana (C Felony), Possession with Intent to Deliver a Controlled Substance- Methamphetamine (Y Felony), Possession of Drug Paraphernalia (C Felony)(CR 01-345-3).
This notice is issued based on the date of conviction (2002 – Saline County), the fact that all terms of the applicant’s sentence have been completed and there have been no further felony criminal-law violations. There are no law enforcement objections to the application.
James K. Walters (Dover): Jury Tampering (D Felony) (CR 99-134).
This notice is issued based on the date of convictions (1999 - Pope County), the fact that all terms of the applicant’s sentence have been completed and there have been no further criminal-law violations. There are no law enforcement objections to the application.
Governor Hutchinson intends to grant a commutation of sentence to the following people:
Kentrell L. Hill (ADC #095734): Del Cont Subs, 2 counts and Poss of Cont Subs W/Intent, 1 count (Habitual Offender) (Y Felony), Poss Cont Subs 2nd offense (Habitual Offender) (D Felony), Poss Drug Paraphern. (Habitual Offender) (C Felony), Maintaining Drug Premises (Habitual Offender) (D Felony), and Dist Near Crtn Facilities Enhancement, 3 counts (Unclassified) (2004-110) (Jury Trial).
The governor has given notice of his intent to commute the sentence of Kentrell L. Hill, who was convicted in Ouachita County in 2005 for the above offenses, from a total of 420 months in the Department of Correction on counts 1 through 3 consecutive to each other, 72 months in the Department of Correction on count 3, 144 months in the Department of Correction on count 4, 72 months in the Department of Correction on count 5 concurrent, and 120 months in the Department of Correction on counts 6 though 8 consecutive to each other and consecutive to AC-001 for a total of 1,620 months or 135 years in Department of Correction to making him immediately eligible for parole. There are no law enforcement objections to applicants request.
Tommy L. Lucky (ADC #083529): Aggravated Robbery (Y Felony) (1989-624) (Bench Trial);
The governor has given notice of his intent to commute the sentence of Tommy L. Lucky, who was convicted in Pulaski County in 1989 for the above offenses, from a total of 100 years in the Department of Corrections to making him immediately eligible for parole. The Prosecuting Attorney has raised objections to applicant's request.
Tywanna F. Martin (ADC #701951): Capital Murder (Y Felony) (1977-1944)
The governor has given notice of his intent to commute the sentence of Tywanna F. Martin, who was convicted in Pulaski County in 1978 for the above offenses, from Life Without Parole to Time Served. The Sheriff and Prosecuting Attorney have raised objections to applicant's request.
