ACTION ALERT   Oppose Senate Bill 111 Please email your Michigan state senator today to ask them to vote NO on Senate Bill 111. Senate Bill 111 is a very poorly written bill threatening self-defense rights without the safeguards that exist in current law. It is far worse than even Michigan's new Red Flag law. On its surface, Senate Bill 111 would "enhance protections against financial exploitation, abuse, and neglect of seniors and vulnerable adults." Specifically, it would create a process for certain senior and vulnerable adults to petition a circuit court to enter an elder and vulnerable adult personal protection order (PPO). However, the language in Senate Bill 111 contains a gun ban that is far broader than even Michigan's current Red Flag law. SB 111 allows these PPOs to be used to restrain respondents from purchasing or possessing firearms based only on reasonable cause to believe the respondent may purchase or possess a firearm -constitutionally protected activities- without any requirement that the petitioner show harm or a real threat of harm including prior conduct of the respondent or even limitations on the relationship between the petitioner and the respondent. The safeguards that have existed for decades in preventing abuse of Michigan's PPO law are missing from Senate Bill 111. In short, grandma could prevent her grandkid from assembling an AR-15, or prevent her neighbor from purchasing a shotgun for home defense, or even restrain a delivery driver from carrying a pistol for self-defense. This is a significant expansion of Red Flag. Not only can these PPOs be served ex parte and entered into the CJIS immediately without the respondent having been served or given an opportunity to respond, but the bill neglects to include any of the limitations of Michigan's current Red Flag law. As Senator Jim Runestad (R-White Lake), the Republican Vice-Chair of the Senate Judiciary Committee explained during committee testimony, "The language is so broadly written, almost like they wanted to shoehorn in violations of our Second Amendment rights." He went on to add, "My experience is that the majority [Democrats] likes poorly written bills for messaging purposes, poison pills that nobody should be voting for, in order to message that if you don't vote for this you don't like vulnerable adults. So it probably won't be changed." As Senator Runestad correctly predicted, the bill was reported out of the Senate Judiciary Committee this morning on a partisan 5-2 vote despite the committee being aware of the problems in the bill and not correcting them. It was then immediately sent to the order of Third Reading in the Senate to prevent any new amendments to the bill. We anticipate the bill will be voted on as early as tomorrow.
