Over the weekend, JD Vance took to Elon Musk’s Twitter/X to propose a new attack on the Constitution.

He tweeted:

“If a judge tried to tell a general how to conduct a military operation, that would be illegal. If a judge tried to command the attorney general in how to use her discretion as a prosecutor, that's also illegal. Judges aren't allowed to control the executive's legitimate power.”

Not only is that dead wrong about the role of the courts in determining what the executive’s legitimate power is, it marks a new and terrifying descent into authoritarianism from the Vice President.

And there’s reporting out today that the Trump administration is indeed ignoring court orders to release billions of federal funding!

Judicial review, the concept that our courts have the duty to review legislation and executive actions to determine if they are legal and constitutional, is a constitutional principle that was established early in the days of our nation. For almost as long as there has been a federal courts system, all our branches of government have been subject to judicial review.

The Vice President’s comments paint a picture of unrestricted presidential power wielded by Donald Trump and the administration. This is alarmingly dangerous and smacks of authoritarianism.

This is unprecedented. Congress must act to reaffirm the importance of our constitution and constitutional principles. The silence of leaders in Congress on this issue is unacceptable. We must fight to protect our democracy.
