Imagine a 150-year-old law being misused to essentially ban abortion nationwide—even in states where it's currently legal. That's exactly what anti-abortion extremists are trying to do with the Comstock Act.
What is the Comstock Act?
Originally passed in 1873, the Comstock Act banned mailing anything that could be considered "obscene." Since then, courts have ruled Comstock doesn't apply in the way it initially would have in the 1800s.
How Does It Threaten Abortion Today?
Donald Trump and anti-abortion politicians are trying to misuse this law as a backdoor abortion ban. If they succeed:
✅ Medication abortion could be inaccessible nationwide (even in blue states).
✅ Doctors, pharmacists, and even mail carriers could be criminalized for helping people access abortion care.
✅ Medical equipment used in abortion care could be illegal to ship.
If doctors don't have the medication or medical equipment they need to provide an abortion, that's an abortion ban.
What's at Stake?
With Trump in the White House, and Pam Bondi leading the Department of Justice, they and their teams could try to misuse their radical interpretation of the Comstock Act overnight, eliminating abortion access across the country—without Congress passing a single new law. The impact would be devastating, even in states where abortion is protected.
