Polluters are poisoning our water and regulators are failing to act. That’s a fact and we’re fighting back with a major lawsuit to hold them accountable and stop this toxic pollution that could threaten millions before more damage is done. We can’t do this alone. This week, Waterkeeper Alliance, Bayou City Waterkeeper, Waterkeepers Florida, Center for Biological Diversity and other conservation groups took EPA to court ([link removed]*1e9eyu0*_gcl_au*MjAyNjIwMTg3LjE3NDE5NzI3ODg.) for ignoring a petition demanding tougher regulation of toxic and radioactive waste from phosphate mining and fertilizer production. Phosphogypsum and its byproducts are contaminated with radioactive Radium-226, which has a 1,600-year half-life, as well as carcinogens and deadly metals like arsenic, lead, and mercury.

The phosphate industry is exempt from hazardous waste laws, forcing the public to bear the cost of pollution while companies like Mosaic Co. raked ([link removed]) in $2.2 billion in 2024. This lack of oversight directly led to devastating environmental disasters in Florida, Louisiana, and Idaho.
* The 2021 Piney Point discharge of toxic waste into Tampa Bay triggered a deadly red tide, killing more than 1,600 tons of marine life, including tens of thousands of fish.
* Mosaic’s New Wales plant has had at least four major sinkholes, including one that leaked ([link removed]) 200 million gallons of wastewater and radioactive phosphogypsum into the Floridan aquifer.
* Mosaic’s Riverview plant likelyreleased nearly 40,000 gallons of process wastewater ([link removed]) into Tampa Bay after Hurricane Milton last October.
* Mosaic’s Uncle Sam Plant in St. James Parish is poised to expanddespite structural integrity concerns ([link removed]) and J.R. Simplot’s Don Plant continues tocontribute pollution ([link removed]) to a designated Superfund site in Idaho.
