This week, my team at Earthjustice sued to challenge the Trump administration’s attempt to “terminate” New York’s congestion pricing program.
This case is about more than just one policy: it’s about fighting back against the administration’s illegal attempts to meddle in states’ environmental policies across the country.

In January: New York’s congestion pricing policy went into effect. It has had an immediate positive impact on traffic and air quality in New York City, while raising millions to finance major transit projects.
On February 19: Trump officials ordered New York to end the program, abruptly claiming they had discovered it was illegal. This action would nix the city’s opportunity for cleaner air and safer streets, while also robbing it of critical funding to improve the languishing mass transit system that approximately 5 million people ride every day.
On Tuesday of this week: Earthjustice, on behalf of rider groups and grassroots environmental advocates, sued to stop this illegal power grab.
In its rush to end congestion pricing, the Trump administration is selling a flimsy excuse to try and make an end run around what the laws require. But the administration’s explanations don’t add up, and we’re confident that the courts are going to see through them just as easily as most New Yorkers do.
