BREAKING: Earthjustice files first environmental lawsuit against new Trump admin

Earthjustice is suing to restore protections to millions of acres of irreplaceable public waters that President Trump is illegally attempting to open for offshore drilling. The ocean protections cover areas along each United States coastline that are currently undeveloped and where 40% of Americans reside.
Trump tried this during his first administration, too. We sued and stopped him then. Now, standing with our partners, we’ll see Trump in court once again.

Here’s what happened:
  1. Every president this century has protected public waters. President Biden protected millions of acres of public waters — in places like the fragile Arctic Ocean, the biologically rich California coast, and the clear waters of Florida’s Gulf Coast — from future offshore drilling. Biden, like seven presidents before him, including Trump, protected those public waters under the Outer Continental Shelf Lands Act.
  2. On his first day, President Trump signed an executive order to remove those protections. But the law does not give the president the authority to undo protections put in place by prior administrations. Only Congress has the power to do so.
  3. Earthjustice sued to invalidate Trump’s illegal attempt to revoke these offshore protections.

Here’s what’s at stake:
  • Sacrificing public lands and waters to dirty fuel: The Trump administration’s order is part of a broader push to dramatically increase oil and gas drilling. This push threatens both the Gulf of Mexico, where 99% of U.S. offshore production takes place, and places like the Arctic and Atlantic Oceans that are currently free of offshore drilling.
  • Every oil spill in our oceans starts with a lease sale. Allowing any expansion of offshore development threatens millions of people living along our coasts, thousands of businesses, and invaluable ecosystems that are integral to marine wildlife.
  • Withdrawing protections from the waters will not impact U.S. energy security. The U.S. is already producing more oil than any nation at any time in history and is also the world’s largest producer of gas.
  • Distraction: President Trump’s manufactured “energy crisis” serves to distract from the fossil fuel-driven climate crisis and ignores the reality of the oil industry’s vast stockpile.
We are prepared for numerous legal battles with the second Trump administration. That isn’t to say fighting Trump’s agenda will be easy. He will try to accelerate the drilling that will deepen our country’s dependence on fossil fuels, to gut the regulations that protect clean air and water and keep toxic chemicals out of our bodies, and to appoint more ideological judges that will further politicize our courts and erode government protections that we all depend on.
