** If local officials could hinder a federal government evil, would you want that?
------------------------------------------------------------
We need your help filing an amicus brief to the Supreme Court in Missouri v. United States of America. We are to be one of only two amicus curiae briefs filed in this case.
Most legislation sucks, but man, Missouri's SAPA (Second Amendment Preservation Act) is some righteous stuff. Get this. SAPA says...
** Certain federal firearm restrictions violate your constitutional rights
------------------------------------------------------------
SAPA lists specifics. The violations include any...
- Tax, levy, fee, or stamp imposed on firearms, accessories, or ammunition
- Firearm registration or tracking
- Acts forbidding possession, ownership, use, or transfer by law-abiding citizens
- Confiscation of firearms from law-abiding citizens
But so what if SAPA lists these specific violations? What can little Missouri do against the mighty federal government?
This law is clever. It doesn't nullify federal law. It doesn't fight the feds. It doesn't even prevent the feds from enforcing any federal laws. Instead...
SAPA makes it illegal for Missouri state officials to enforce these bad federal laws, or to assist federal officials in doing so.
Bureaucracies, like the ATF and FBI, rely on their power to commandeer, partner with, or utilize state, county, or local manpower, equipment, or facilities to achieve these unconstitutional ends.
Just imagine if all states did this on all federal laws and regulations that violate the Bill of Rights!
Needless to say, this made the feds furious. So they sued Missouri. They're arguing that the "supremacy clause" makes SAPA unconstitutional. But…
** Does the supremacy clause even apply?
------------------------------------------------------------
The district court agreed with the feds, saying SAPA violates the supremacy clause. This was predictable.
We filed an amicus brief when the 8th Circuit Court of Appeals considered it. They agreed with the district court, so now…
We're filing an amicus brief urging the Supreme Court to take up this matter. We want to counter the errant claim that the supremacy clause refutes SAPA.
And we want our great arguments in their heads when they do that!
- SAPA simply states that federal authorities can't use Missouri's resources to enforce their laws.
- Our brief will also point out that the district court overlooked precedents affirming state legislatures' role in upholding constitutional rights, like the Second Amendment.
- Furthermore, the supremacy clause doesn't cover unconstitutional actions by the federal government, and the courts have consistently agreed. We aim to highlight this crucial point
- Even better, our brief will show that the district court didn't actually say Missouri can't enforce SAPA. It just didn't like how forcefully Missouri made its case.
That last point is just silly. We want to call them on it. Will you help us do that?
At stake is a whole new avenue for checking and balancing overweening federal power.
We need your financial help to file this brief. Remember, in this case, only one other amicus curiae brief will be filed for the SAPA side. That's why we must ask, "Will you contribute?"
There is no limit to how much you can donate to our amicus brief program. We need at least one, two, or three persons to get us to the first $2,000.
Then, we will also need contributions of all sizes. The average contribution is $55, but any amount you give will help. You can also start a monthly pledge.
Note: We're requesting your support via Downsize DC Foundation's "Zero Aggression Project." By using the ZAP form, your donation can be tax-deductible.

One of my greatest pleasures is reporting back to you on the results of these briefs because I can often bring you good news. I would like to do that again with this case, if we can have your donation to fund the brief.
Thank you in advance for your participation!
