WASHINGTON, D.C. – Today, America First Legal (AFL) announced a settlement agreement with Texas Tech University Health Sciences Center (Texas Tech) in a lawsuit challenging racially discriminatory admissions practices.
The lawsuit, brought by AFL and co-counsel Jonathan Mitchell on behalf of their client, was filed in the U.S. District Court for the Northern District of Texas on January 10, 2023. It challenged Texas Tech medical school’s admission policy, alleging racial preferences in violation of Title VI of the Civil Rights Act of 1964, Section 1981 of the Civil Rights Act, and the Equal Protection Clause of the Fourteenth Amendment to the U.S. Constitution.
Texas Tech maintained that its admissions practices were lawful despite statistical analysis showing strong evidence of racial bias. Nevertheless, it has affirmed that it “will not consider race when selecting applicants for admission to its medical school.”

“The Supreme Court of the United States made it clear that race cannot be a consideration in college admissions. It violates the student’s Fourteenth Amendment Constitutional right to equal protection. Divvying up Americans based on race only creates problems and solves none. All universities should take note of Texas Tech's decision and do likewise,” said Nick Barry.
