John,

President Trump created a new federal agency, the so-called “Department of Government Efficiency” (DOGE), without Congressional approval. Even worse, he installed Elon Musk as its head, giving the richest man in the world sweeping, unchecked authority over the entire federal government.

Musk, who was never vetted or confirmed by the Senate, is using this unlawful power to cut the federal government to the bone. While I joined 18 other attorneys general in filing a lawsuit to block DOGE’s access to sensitive personal information, Musk still has the ability to wreak havoc on state and local governments, federal employees, and the American people.

By creating an agency out of thin air and appointing Musk without Congressional approval, President Trump blatantly violated the Appointments Clause of the Constitution.

I didn’t run for office so I could sue President Trump, but as Attorney General, it’s my job to hold him accountable if he oversteps his authority. That’s why I joined 13 other attorneys general in filing a lawsuit to stop this illegal power grab.
