President Trump recently signed an executive order stating that only the president and the attorney general have the authority to interpret the law for the executive branch—including agencies that have long been considered independent.
Our Constitution specifically divides powers among the branches of government, and makes them separate but equal. Article II may grant the president the power to ensure that laws are “faithfully executed,” but it does not give the president authority to interpret those laws.
That role belongs to the judicial branch under Article III, which is meant to serve as a check on the executive and legislative branches.
