SCOTUS decides not to hear two voting cases in upcoming term
In a victory for voters, the U.S. Supreme Court denied an appeal from Montana to reinstate two voter suppression laws. The state wanted the Court to use the radical independent state legislature theory to overturn a decision from the Montana Supreme Court. In a new YouTube video, Marc explains the decision.
The U.S. Supreme Court declined to review a lawsuit alleging Pennsylvania is violating federal law by rejecting mail-in ballots with date errors. But, the Pennsylvania Supreme Court will decide if these rejections violate the state constitution.
GOP state officials sue to exclude certain immigrants from 2030 census
Louisiana, Kansas, Ohio and West Virginia sued the federal government to exclude large categories of immigrants from the census count and add a citizenship question to the 2030 census. This would be a radical departure from how the U.S. population has been counted in past censuses.
Census population counts determine the apportionment of Congressional seats, and in turn, Electoral College votes. The lawsuit claimed that states like Texas and California, which have large immigrant communities, are overrepresented in Congress because noncitizens are included in population counts.
The last time the U.S. Census asked every respondent a citizenship question was in 1950. The question was removed in part because of concerns about accuracy and the threat of undercounting some populations.
