STATE ENGINEER UPDATES POLICY ON THE BEAVER DAM ANALOG (BDA) RESERVOIR PERMIT APPLICATION PROCESS


On April 4, 2018, the State Engineer issued policy guidance to the Surface Water Division regarding applications and permitting of BDAs which has been implemented since that time. In September 2023, the Wyoming Stock Growers Association submitted comments to the 2023 Regulatory Reduction Task Force requesting that agencies review current permitting processes for BDAs and explore opportunities to streamline those processes. To discuss those comments, an interagency workgroup meeting was held on December 19, 2023 in Cheyenne.

In response to public comments received during the December 2023 meeting, the State Engineer’s Office’s analysis of those comments, and based on experience since the 2018 guidance was issued, the BDA permit application process was updated. Specifically, the updated policy allows an applicant to file for up to 20 structures on a single permit so long as the upstream-most reservoir is located within 1,320 linear feet of the downstream-most reservoir. The total volume of storage allowed per single permit remains unchanged at 20 acre-feet.
