Republicans are trying to use the courts to steal a critical state Supreme Court victory in North Carolina – with far-reaching impacts that could affect control of Congress for years to come.
Justice Allison Riggs won her State Supreme Court race by just 734 votes after every single ballot was counted, recounted, and recounted again. But now, the Republican-controlled North Carolina Supreme Court has taken the unprecedented step of blocking the election results from being certified.
This Republican-controlled court, with a partisan 5-2 majority, has already demonstrated its willingness to make decisions driven by partisan gain rather than legal merit. Last year, they rubber-stamped extreme gerrymandered maps that diluted the power of voters and extended unfair Republican advantages in congressional and legislative races.
ProPublica reports that the Republicans' argument relies on "debunked legal theories...that originated and have been championed by far-right activists working with a conservative organization that was secretly preparing to contest election results if Trump had lost the 2024 election." Their goal? To throw out valid ballots and overturn the will of the voters.
This is part of a larger Republican strategy to weaponize the courts to cling to power no matter what voters want. If they succeed, they will cement Republicans' ability to gerrymander districts, suppress votes, and rubber-stamp extreme legislation for years to come.
