Millions of Americans’ lives, rights, and bodies are on the line as we near Trump’s second presidential term. He’s threatened the rights of so many of us, including women, LGBTQ+ people, sexual assault survivors, and anyone who can get pregnant.
But we have an important tool to fight for abortion access, gender-affirming care, improved Black maternal healthcare, equity in the workplace, and more: the Equal Rights Amendment to the U.S. Constitution. If officially part of our Constitution, this would establish equal rights regardless of sex or gender, which we could use to fight for the fundamental rights and freedoms of a majority of Americans.
This constitutional amendment has met the requirements to be an official part of the Constitution: It’s been approved in 38 states and passed by 2/3 of Congress. We just need President Biden to act. That’s why I recently joined more than 120 of my colleagues in the U.S. House of Representatives to send a letter urging the president to certify and publish the Equal Rights Amendment now.

Joe Biden is still president until January 20, and in his final weeks he has the power to publish the Equal Rights Amendment to the Constitution, which is one of our best tools to protect women and LGBTQ+ people from Trump and Republican attacks.
This simple amendment proclaims that: “Equality of rights under the law shall not be denied or abridged by the United States or by any state on account of sex.” If officially part of the Constitution, this 28th Amendment would help eliminate the gender pay gap and fight back against other discrimination based on sex, gender identity, and sexuality—including protecting access to abortion, birth control, and gender-affirming healthcare.
At the state level, Equal Rights Amendments to state constitutions have successfully established a legal basis for protecting reproductive rights. We urgently need this at the federal level before Trump occupies the White House again and follows through on his promises to ban abortion and attack queer and trans people, women, sexual assault survivors, and more marginalized people.

Thousands of activists around the country have also taken action in the past month to demand this key tool to save lives and protect women, LGBTQ+ people, sexual assault survivors, abortion rights, Black maternal health, workers’ rights, our bodily autonomy, and more. Feminists have fought for this for over 100 years, and it’s past time for all of us to be written directly into the U.S. Constitution.
Fortunately, the Equal Rights Amendment (ERA) has met the threshold for its ratification, with approval from 38 states and passage by 2/3 of Congress. Now all we need is President Biden to act by directing the U.S. Archivist to certify and publish the ERA now.
