Division: *Insurance Services (Self-Insurance Program)*

Topic: *Expedited Proposal (CR-105) – Self-Insurance Reserve Fund (SB 5084 Implementation)*

Brief Description: The purpose of this expedited rulemaking is to propose amendments to Chapter 296-15 WAC, Workers' compensation self-insurance rules and regulations.  In 2023, Washington state lawmakers enacted Senate Bill 5084 [ [link removed] ] (SB 5084), Chapter 110, Laws of 2023, which created the self-insurance reserve fund to hold self-insured employers’ second injury fund assessments and other pre-funded pension obligations. The proposed amendments will update two section in rule governing the Self-Insurance Program, aligning them with statutory changes required under SB 5084. The proposed formatting changes make it easier to read.

L&I determined that expedited rulemaking is appropriate because the proposed language includes content explicitly dictated by statute, and makes name changes and clarifies language without changing its effect.

Division: *Field Services and Public Safety (Boiler Program)*

Topic: *Proposal (CR-102) – Boiler Rule: Pool Heater Definition & Fee Increases (FY26)*

Brief Description: The purpose of this rulemaking is to amend the boiler rule under Chapter 296-104 WAC, Board of boiler rules – Substantive. The proposed amendments would affect the fees and definitions for boilers and pressure vessels. This rulemaking is needed to ensure the inspection requirements for pool heaters are clear to improve public safety, and that fees will support the Boiler Program’s operating expenses. The fee increase of 6.41% is the Office of Financial Management’s (OFM) maximum allowable fiscal growth factor for fiscal year 2026. According to RCW 70.79.330 and 70.79.350, a fee schedule for inspections is to be set by the Board of Boiler Rules and the fees are to be used to administer the Boiler Program.

Topic: *Preproposal (CR-101) – Electrical Fees Increase (FY26)*

Brief Description: The purpose of this rulemaking is to consider amendments to the electrical rule, Chapter 296-46B WAC, Electrical safety standards, administration, and installation, that would increase fees by the fiscal growth factor of 6.41% for electrical inspections and other Electrical Program services. The fee increase is necessary to cover increased operating expenses for the Electrical Program. The current fee levels are insufficient to cover current Program expenses. The fee increase would ensure that revenues match expenditures.
