President Biden reportedly wanted the Department of Justice to target Donald Trump for prosecution more aggressively than it did, and regrets naming Merrick Garland as Attorney General. In private, Biden has also said he should have picked someone other than Garland as attorney general, complaining about his slowness in prosecuting Trump and aggressiveness in prosecuting Biden’s son Hunter.

Judicial Watch filed a FOIA lawsuit against the Department of Justice seeking documents related to invoking the 25th Amendment against President Joe Biden. Special Counsel Robert Hur's report said: It would be difficult to convince a jury that they should convict him-by then a former president well into his eighties-of a serious felony that requires a mental state of willfulness.
