Email from Finchem for AZ Senate BIG court decision!     Hello John, Monday's court decision was a major victory for the rule of law, the separation of powers, and the integrity of our elections. The Maricopa County Superior Court invalidated key provisions of the 2023 Elections Procedures Manual (EPM) pushed by Secretary of State Adrian Fontes. The court ruled decisively: Fontes overstepped his authority and violated Arizona law! As your State Senator-elect, I applaud this decision. It's proof that when we stand firm, we can protect the principles that make our elections fair and transparent. Here's what the court struck down: Non-Residency of Juror Questionnaire Rule: Fontes tried to treat non-resident voter registrations as ""inactive"" instead of canceling them as required by law. The court rightly stopped this unlawful rule. Validity of Circulator Registrations Rule: Fontes wanted to excuse errors in circulator registrations for initiatives and referendums, weakening the strict compliance required to protect ballot integrity. The court said no. Duty to Canvass Rule: Fontes attempted to limit the authority of county Boards of Supervisors in the canvassing process and gave himself the power to exclude county results from the statewide canvass. The court shut this down, safeguarding the transparency and accountability of our election process. This ruling is a reminder that the Arizona Legislature—not unelected bureaucrats—has the final say on our election laws. But make no mistake: this fight isn't over.
