Here at LEAF, we’re preparing for a big year ahead – one that includes fighting for access to justice for survivors of family violence. Now, more than ever, it is critical that we come together to defend and advance the rights of women, girls, trans, and non-binary people.

Family violence is systemic. It takes a physical, psychological, and financial toll on victims, and the violence is often sustained for years by someone you are supposed to trust and rely on. This insidious form of violence disproportionately impacts women, particularly those facing intersecting forms of marginalization.
Last month, LEAF was granted leave to intervene in a Supreme Court case that could lead to the creation of a new tort of family violence.
A tort is a wrong specifically recognized by the legal system, and for which the legal system can provide a remedy like monetary damages. Historically, survivors of family violence seeking compensation would have to try and combine separate individual torts, such as assault, battery, and the intentional infliction of emotional distress.
Existing torts are not nearly enough to redress the systemic harms of family violence. We know the law can—and must—do better.
A family violence tort would be an important step in the right direction. It could lead to higher compensation for survivors, better encourage them to seek compensation in the first place and ultimately help deter family violence.
We'll be going to the Supreme Court of Canada in February 2025 to intervene in this case. As we look to 2025, please consider giving today to strengthen this critical work.
