Before Trump takes office, President Biden has a critical opportunity to stand for equality simply by telling the Archivist of the United States to publish the Equal Rights Amendment (ERA).¹

The ERA would provide vital Constitutional protections to women and the LGBTQIA+ community. The amendment reads: “Equality of rights under the law shall not be denied or abridged by the United States or by any state on account of sex.”

President Biden just has to tell the Archivist to publish equality in the Constitution. That's it.

In January 2020, Virginia became the 38th state to ratify ERA, the last state required to add the amendment to the Constitution. But the prior Archivist of the United States refused to publish the amendment.

The American Bar Association affirmed that the ERA has met all constitutional requirements, and called on all forms of government to implement the amendment immediately.

Now, President Biden must simply instruct the new Archivist to publish the ERA and guarantee equal rights.
