Right now, women, girls, and members of the LGBTQIA+ community are under attack from state legislatures.
President Trump’s second term threatens to expand many of these attacks to the federal level by enforcing the Comstock Act, which would effectively create a nationwide abortion ban; banning gender-affirming care; and eliminating equal protections against sex discrimination under the 14th Amendment.
The fastest and most effective way to stop this from happening is to publish the Equal Rights Amendment (ERA) as the 28th Amendment to the Constitution.
The Constitution does not currently include any protections on the basis of sex. The Equal Rights Amendment would establish these protections for women and the LGBTQIA+ community while grounding our democracy in fundamental human equality under the law.
It has been more than four years since Virginia became the 38th state to ratify the ERA, satisfying the constitutional requirements to make it the 28th Amendment. President Biden just has to instruct the National Archivist to publish it and make it the law of the land.
With so many freedoms on the line, President Biden has the authority, responsibility, and opportunity to certify the ERA before his term ends.
