“Kim Ogg seeking death penalty in Jocelyn Nungaray killing,” Houston Chronicle's Nicole Hensley — “Harris County prosecutors are expected to seek the death penalty against two men charged in the death of 12-year-old Jocelyn Nungaray, according to officials.

The option to seek the death penalty at trial means jurors can consider to sentence Johan Jose Martinez-Rangel and Franklin Peña to die as a form of punishment. Court filings are expected Friday to elaborate on their decision to seek the death penalty, according to a Harris County District Attorney's Office news release.

Peña's defense attorney Daniel Werlinger said he and other lawyers received notice in November through the trial prosecutors that the punishment would be sought.

"We see this as old news. We knew we were going to be in this position from Day 1 but now it's official," Werlinger said.

The original charge against both men was filed as capital murder of a person older than 10 and younger than 15 years old, which excluded prosecutors from seeking death as a possible punishment before a jury. The charges were clarified in September to reflect Jocelyn was sexually assaulted.
