Dear Friend,
After hosting 19 town halls, showing up and listening to the people of Colorado, we challenged the proposed merger between Kroger (owner of King Soopers and City Market) and Albertsons (owner of Safeway) in Colorado state court.
This week, two parallel court challenges–in federal court in Oregon and in state court in Washington–ruled against the merger. These victories bolster our case here in Colorado.

For Coloradans, this case shows the power of how we can protect each other by listening, working together, and standing up for what’s right.
I’m grateful for the Federal Trade Commission, which partnered with us on this fight, and Chairwoman Khan, who joined us for our final town hall in Denver.
At that event, Chairwoman Khan asked the obvious question that was asked at every single town hall: “Does anyone here think this merger is good for Colorado?” And once again, no one did. Not a single person said that this merger would be good for consumers, workers, or farmers.
While the Colorado court has yet to rule on the merger, the other two rulings underscore the power of our case and have acted to stop the merger. We are more confident than ever that the Colorado court will follow suit, protecting us from higher grocery prices, store closures, and job losses.
Beyond stopping the merger, I am still seeking to hold the companies accountable for additional illegal actions during the recent King Soopers’ strike. We presented evidence that they conspired to not hire workers from the other company and agreed to not solicit each others' pharmacy customers. They must be held accountable for such actions.
When we work together, we can take on big fights and overcome ever bigger challenges.
