ACTION ALERT   Critical Anti-Gun Bills Moving in Lame Duck MCRGO needs you to contact your state legislators now to stop the passage of two pieces of legislation critical to all Michigan gun owners. These are the elimination of local government preemption (House Bill 4198) and the Firearms Industry Responsibility Act (House Bills 6183, 6184, & 6185). Other anti-gun bills are also moving this week. Local Government Preemption Michigan law currently prevents local units of government from adopting gun control ordinances stricter than state law. This law, often informally called "preemption," was affirmed in 2002 through the landmark case MCRGO v. Ferndale. Firearms preemption laws prevent a confusing patchwork of varying firearms restrictions across a state. Currently, 45 states have firearms preemption laws. The City of Detroit is asking legislators to eliminate preemption so it can ban firearms in Greektown. In addition to turning Detroit into a new Chicago as it pertains to gun bans, the impact of this bill would be felt in counties, cities, townships, and villages across the state, making it very difficult to travel in Michigan while carrying a pistol for self-defense. While the bill as introduced focuses on open carry, there is a strong likelihood of it being amended to impact all carry. Firearms Industry Responsibility Act State law and federal law currently shields manufacturers of firearms, firearms components, and ammunition from frivolous lawsuits based on the misuse of their products. The Firearms Industry Responsibility Act would remove those protections for manufacturers located in Michigan by enacting "a public nuisance through the sale, manufacture, importing, or marketing of a firearm-related product." The legislation would require manufacturers to implement "reasonable controls" on the use of their products "if the harm to the public is a reasonably foreseeable effect of the conduct, notwithstanding any intervening actions, including unlawful actions by third parties." In short, the legislation attempts to eliminate the firearms industry in Michigan by exposing it to expensive lawsuits based on criminal use of its products. While the legislation mentioned above is the most damaging to defensive carry in our state, these are not the only anti-gun bills moving in the crazy final days of the Lame Duck legislative session. There are currently 100 bills up for consideration before the full Michigan House of Representatives at the moment. The House is fast-tracking legislation, often bypassing the committee process as we saw yesterday with the Capitol & Legislative Office Buildings Carry Ban (Senate Bills 857 & 858). Dozens of bills are being voted on every session day, often with little time given for deliberation. Aware of their impending loss of control of the Michigan House of Representatives, anti-gun Democrats are desperate to get as many gun control bills passed as they can. Due to the constitutional requirement that bills lay over for five calendar days between chambers, any bill that is to move forward must pass the chamber it was introduced in by the end of this week. The House Democratic Caucus needs all of its 56 members present to pass any legislation on a party-line vote. While session has been scheduled for Monday, December 23 and there could be a working session day yet after Christmas, it's unlikely there will be enough legislators present during the holidays to pass bills on party-line votes. Republicans legislators have been unified in opposition to the passage of gun control legislation in Lame Duck. It only requires a single Democratic legislator not voting "Yes" in either the House or Senate to block passage. Most of these legislators will be running for re-election in 2026.
