WILL Comes to Defense of Wisconsin Mom's Fight Against DEI

WILL is preparing legal action against the Green Bay Area Public School District on behalf of a mother whose dyslexic son was denied reading resources because of his race.

Mrs. Decker’s son was diagnosed with dyslexia in 2022, and they have sought support from the school ever since he enrolled in January 2024.

Throughout 2024, Mrs. Decker repeatedly provided documentation and made formal requests for one-on-one reading interventions. In April 2024, Mrs. Decker’s son was placed on a wait list for reading intervention, albeit for a less intensive program, even though his needs clearly required more support.

This impacts him in the classroom, where his teachers, despite their willingness to help, lack the expertise or time to provide effective interventions. 

WILL Gains Ground with SCOTUS Justices

The Supreme Court of the United States (SCOTUS) narrowly denied a Writ of Certiorari filed earlier this year in Parents Protecting Our Children v. Eau Claire Area School District. 

Despite this decision from SCOTUS, WILL's argument and reasoning is elevated in several passages–including in the dissent from Justices Alito, Thomas, and Kavanaugh.

WILL, alongside America First Legal (AFL), sought SCOTUS review on behalf of an association of Wisconsin parents who opposed a school district’s secret gender transition policy that sidelined parental consent. WILL and AFL lost on standing in lower courts and never reached the merits.

WILL Wins In Health Equality Fight!

WILL applauded the Centers for Medicare & Medicaid Services (CMS) for its recent decision to back away from certain components of a proposed federal rule that would have required kidney transplant hospitals to submit “health equity plans” to the agency under the threat of penalty.

The rule—known as the Increasing Organ Transplant Access Model or “IOTA Model”—will pilot a scoring system that informs Medicare payments to (or from) participating kidney transplant hospitals in hopes of incentivizing hospitals to boost organ transplantation access.

Following comments from us and others, CMS will no longer require participating kidney transplant hospitals to submit health equity plans. However, the agency has nevertheless finalized the rule to allow transplant hospitals the option to submit voluntary plans as briefly summarized in the screenshots below. This is a major win for true equality!

Act 10 Declared Unconstitutional... What That Means for Wisconsin

WILL responded to a new ruling striking down key components of Act 10, the collective bargaining reform legislation signed into law by then Governor Scott Walker in 2011.

Rick Esenberg, WILL President and General Counsel, stated, “Not only does this put taxpayers back on the hook for billions of dollars, it opens the door to allow judges – whether they be liberal, conservative or otherwise – to undermine the legislative process.”

WILL recently took a look at what the end of the collective bargaining reforms under Act 10 would mean for local governments and school districts. The reports estimated about $1.1 billion in new annual costs for school districts and more than $480 million in new annual costs for local governments.
