** Supreme Court Hears Arguments on Help Not Harm!

Dear John,

On Wednesday, the U.S. Supreme Court heard oral arguments in U.S. v. Skrmetti, a case that will decide the fate of 23 Help Not Harm-style laws around the nation that protect children struggling with gender dysphoria from irreversibly harmful sex change procedures. FPA staff were on the ground at the Court, listening to the oral arguments and speaking at a rally in front of the Court, and wanted to send you a brief report on some positive aspects of the arguments!

Almost immediately after the oral arguments began, the U.S. Solicitor General, arguing for the Biden Administration in opposition to these laws, was forced to concede that there are, in fact, biological differences between male and female. Whether she knew it or not, this admission affirms the sex binary, which explodes the supposed spectrum at the heart of gender ideology. This is very helpful for not just this issue of protecting vulnerable children, but for any issue dealing with sex and gender. Speaking of that…

Justice Kavanaugh astutely asked about the implications for this case’s outcome on the Save Girls Sports movement. The Solicitor General correctly pointed out that the lawsuits over men competing in girls’ sports involve a separate set of state interests, which Justice Kavanaugh rightly agreed with. But getting on record the fact that those implications do, in fact, exist, is very helpful for the Save Girls Sports movement. FPA got that movement off the ground years ago by helping to pass the very first Save Girls Sports bill in Idaho. Since then, 24 states have passed similar laws ensuring women's sports are for biological women, and the issue only continues to get more popular.

The Biden Administration also argued passionately that Tennessee's Help Not Harm Law supposedly discriminates on the basis of sex. But sex discrimination is very clearly not in Tennessee’s law, nor is it in any of the other 22 Help Not Harm-style laws around the country. These laws are based on our original model Help Not Harm bill. The Solicitor General gave this argument one final try in her rebuttal by focusing on one of the plaintiffs: “he [a young women with gender dysphoria] can’t have these treatments because of his birth sex”—that is not correct: he cannot have them under the law because he is underage and they are harmful (and therefore not medical care).
