When the new administration enters the White House in January, the Brennan Center will do what we do best: defend the Constitution and the rule of law. We’ve already begun.

Over the past year, we’ve led the charge to reform the Insurrection Act and repeal the Alien Enemies Act, a pair of 200-year-old laws that are outdated and dangerously overbroad. President-elect Trump has said he will use these laws to deploy the military as a domestic police force and carry out mass deportations, likely leading to untold violations of basic civil and human rights.

The story doesn’t have to end there. Judges, governors, and state legislatures can make it harder for Trump to use military force on American streets or grab and detain millions of immigrants without due process. Congress can proactively reform these laws. Unified public opposition can make his overreach politically untenable.
