Today, the U.S. Supreme Court heard oral arguments in FDA v. Triton Distribution – a case that is critical to protecting kids from flavored e-cigarettes that have caused a youth nicotine addiction crisis.

Our legal team and youth ambassadors were there to help ensure the Supreme Court puts our kids' health above tobacco industry profits – and that it upholds the FDA's authority to keep kid-friendly e-cigarette flavors off the market.

BACKGROUND

The FDA ordered e-cigarette manufacturer Triton Distribution to stop selling products with flavors that are obviously meant to appeal to kids – flavors like “Jimmy the Juice Man Peachy Strawberry,” “Suicide Bunny Mother’s Milk and Cookies” and "Killer Kustard Blueberry.”

Triton then filed a lawsuit against the FDA in the Fifth Circuit Court of Appeals, known for decisions that aren't friendly to public health. The Campaign for Tobacco-Free Kids helped the FDA fight Triton in court.

But the Fifth Circuit sided with Triton.

Now, the Supreme Court has taken up the case, and we're working to ensure it overturns the Fifth Circuit's misguided decision. We filed a brief with the Court detailing the scientific evidence to support the FDA’s decisions, and we were at the Court today to ensure the media and the public understand the threat that flavored e-cigarettes pose to kids. If left to stand, the Fifth Circuit’s decision would cause great harm to public health and it would undermine the FDA’s efforts to protect children from nicotine-loaded, candy-flavored e-cigarettes.
