As attacks on the rights of women, girls, and LGBTQ+ individuals surge nationwide, a second Trump term comes with grave new threats spelled out in Project 2025. These include enforcing the Comstock Act, which would effectively create a nationwide abortion ban; banning gender-affirming care; and eliminating equal protections against sex discrimination under the 14th Amendment.
It has been more than four years since Virginia became the 38th state to ratify the ERA, satisfying the constitutional requirements to make it the 28th Amendment. Under the first Trump Administration, former Attorney General Bill Barr issued a problematic advisory opinion that the ERA could not be published due to an irrelevant timeline not applicable to the ERA. President Biden has had four years to correct this memo, which deterred former National Archivist David Ferriero from publishing the ERA, and to instruct the current Archivist, Dr. Colleen Shogan, to certify it. With less than two months left in his presidency, he must direct the National Archivist to publish the ERA today.
With so many freedoms on the line, President Biden has a moral responsibility to guarantee equal rights regardless of sex under the Constitution before his term ends.
