HSLDA responds to Harvard Professor's Attack on Homeschooling and Parental Rights

HSLDA President J. Michael Smith provides a strong refutation of the claims made by Harvard Professor Elizabeth Bartholet's recent article in the Arizona Law Review. Her article attempts to make the case for effectively outlawing homeschooling in America.
Smith's refutation includes a powerful legal analysis and historical perspective on the fundamental right of educational liberty in this country and is well worth the read. He explains that, "When parents make decisions regarding the upbringing and education of their children, there is a legal presumption that they are acting in the child’s best interest. This includes when they choose to homeschool. This position is supported by a United States Supreme Court case, Parham v. J.R." As the Court's decision contends, 'The statist notion that governmental power should supersede parental authority in all cases because some parents abuse and neglect children is repugnant to the American tradition.' "
